This User Agreement (“This Agreement”) is a legally binding agreement between you and the Myhub Service Operators (“Us”) regarding your use of the Myhub Disk (“This Service”). By using this Service, you fully read, understand, and agree to accept all the terms and conditions of this Agreement as well as our additional rules, which are updated from time to time.
1. Service Definition and Acceptance
1.1 Service Scope
This service provides you with secure cloud storage, file synchronization, multi-end management, full-format preview, high-speed transfer, and related value-added features, supporting digital asset management for personal and non-commercial use.
1.2 Agreement Effectiveness
By registering, signing in, or actually using this service, you agree to be bound by these terms. If you do not agree, you should immediately stop using and sign out of your account.
1.3 Service Changes
We reserve the right to adjust, add, or suspend certain service features based on technical development and operational needs, provided that we do so in advance through platform announcements or email notifications, without bearing any additional liability to you.
2. Account Management
2.1 Account Registration
You need to provide real, valid identity information (such as email) to complete registration, set your own secure password, and take independent responsibility for all actions under your account.
2.2 Account Security
You should safeguard your account information and prohibit transfer, sharing, or selling your account. If you discover that your account has been stolen or that an unusual login has been made, you should immediately notify us by contacting us via email, and we will assist you in taking security measures.
2.3 Account Logout
You can apply to sign out your account through this service settings feature. After signing out, all your file data will be permanently deleted and cannot be recovered, unless otherwise required by law and regulations.
3. Usage Standards and Obligations
3.1 Compliance Usage
You promise to comply with all applicable laws and regulations in your region when using the Services, and not to use the Services for any illegal, infringing, or harmful activities.
3.2 Content Responsibility
You have full intellectual property rights or legal licenses to all files you upload, store, or transmit, and are independently responsible for the legality, authenticity, and integrity of the content.
3.3 Prohibited Behaviors
It is strictly prohibited to use this Service to upload, distribute, store, or perform any of the following actions:
Information in violation of applicable laws;
Content that violates the intellectual property rights, privacy, or other legitimate interests of others;
Destructive programs such as viruses, malware, Trojan horses;
Unauthorized commercial promotion, spam or harassment content;
Reverse engineering, reverse-compilation, decryption or tampering with program code on this Service.
4. Intellectual Property Protection
4.1 Our Rights
All software, interfaces, trademarks, technical solutions, documentation, and other intellectual property rights in the Services are our property, and you may not use, copy, distribute, or modify them without written permission.
4.2 Your Rights
You retain full intellectual property rights to the content of files uploaded to the Service. You grant us limited rights, non-exclusive, global, and free of license fees, solely for the provision, maintenance, and optimization of the Service, and for the core functionality of file syncing and preview.
4.3 Processing of infringement
If you find content in this service that violates your intellectual property rights, you can submit proof of rights by contacting our email address. We will take necessary measures to delete, block, etc. immediately after verification.
5. Data Security and Privacy
5.1 Security Guarantees
We adopt technical measures such as end-to-end encryption, multi-node disaster-resistant backups, and more to ensure your file data is secure during transmission and storage, preventing data loss, leakage, or tampering.
5.2 Data Processing
We process your personal information and file data only to the extent necessary to provide this service, and will not disclose it to any third party without authorization, except as otherwise stipulated by law and regulations.
5.3 Privacy Policy
For details on the privacy protection of this service, please refer to the Myhub Privacy Policy, which is an integral part of this provision and has the same legal force as this provision.
6. Interrupting and Terminating the Service
6.1 Temporary Interrupts
We will do our best to notify in advance and resume service as soon as possible due to temporary service interruptions caused by maintenance, upgrades, irresistible forces, or third-party causes, and will not bear any direct or indirect losses resulting from these.
6.2 Single-party termination
If you seriously violate this provision (e.g., engaging in illegal activities or uploading prohibited content repeatedly in violation), we have the right to unilaterally freeze or terminate your account and services without prior notice, and will not be liable for any compensation.
6.3 Handling of Consequences
After the termination of the service, we have no obligation to retain any of your file data, and you should manually back up all important content before termination.
7. Disclaimer
7.1 Limitation of Responsibility
To the fullest extent permitted by law, we do not make any warranties, express or implied, for the availability or stability of this Service, and do not assume any indirect, incidental, special, or punitive damages arising from service failure, data loss, third-party behavior, etc.
7.2 Third-Party Services
This Service may include links to or integrates third-party services. We take no responsibility for the content, security, or legality of third-party services. Your rights and obligations with the third party are negotiated separately by both parties.
7.3 Irresistible force
We take no responsibility for disruption or loss of service due to unavoidable factors such as earthquakes, typhoons, floods, wars, government actions, network failures, etc.
8. Dispute Resolution and Other
8.1 Applicable Law
The establishment, execution, interpretation and dispute resolution of this provision are governed by the applicable laws of your region, excluding the application of any conflicting law rules.
8.2 Dispute Resolution
Any dispute arising from or related to this provision should first be resolved through friendly negotiation; if negotiation fails, you may file a lawsuit in the courts with jurisdiction in your region.
8.3 Notification and Delivery
All notifications related to this provision may be delivered through a platform notice, in-site letter, or the email address provided when you registered, and upon delivery will be considered valid. Notifications you send to us should be submitted through the contact email address, and we will process them after verification.
8.4 Terms of Integrity
This provision constitutes the complete agreement reached by both parties regarding the use of this Service, replacing all previous oral or written agreements. If any provision of this provision is deemed invalid or unenforceable, it does not affect the legal validity of the other provisions.
